Copyright Notice <\/h2>\n \n \n

The following guidelines and regulations apply to all academic journals and collected <\/span>editions published by Nomos Verlagsgesellschaft mbH & Co. KG (hereinafter \u201cNomos <\/span>Publishing<\/span>\u201d) and its imprints except where Creative Commons licenses or other <\/span>contractual regulations apply. See the individual journal webpages or legal notice of <\/span>print issues for further details.<\/span><\/p>\n\n

1. Author Rights and Publisher Rights <\/h3>\n \n

The complete contents of an academic journal, including individual contributions and <\/span>illustrations contained therein, is protected by copyright laws. Any use not explicitly <\/span>permitted by copyright laws (or the relevant Creative Commons<\/a> license for Open <\/span>Access content is expressly forbidden and requires prior permission from the<\/span>
publishing house or, in the case of Open Access contributions, of the author in <\/span>question.<\/span><\/p>\n

Creative Commons licenses are based on standard license agreements offered by the non-profit organization Creative Commons<\/a> to clarify questions about the reusability of copyrighted content and to promote the distribution of creative content in accordance with the open access principle. Authors can choose between six different standard license agreements<\/a>.<\/p>\n\n

2. Grant of Rights <\/h3>\n \n

If and when a title is accepted for publication, the author grants his or her rights to the <\/span>publisher who then has exclusive (in the case of Open Access publications \u2018non-<\/span>exclusive\u2019), unrestricted rights to the work in all forms and all media, irrespective of <\/span>time and location. This includes but is not limited to the rights to reproduce and <\/span>distribute physical copies of the work, to reproduce and make the work public, to <\/span>include it in databases and to store it on electronic data carriers for the full term of the <\/span>statutory copyright (including all renewals and extensions of that term). This includes <\/span>forms of use that are presently unknown at this time or developed at any time in the <\/span>future.<\/span><\/p>\n\n

3. Secondary Use Rights and Self-Archiving<\/h3>\n \n

After the duration of twelve months, the author is permitted to publish the manuscript <\/span>of his or her work under the regulations specified in \u00a7 38(1) Sentence 2 and (2) of the <\/span>German Copyright Act (hereinafter UrhG). <\/span>The aforementioned regulations do not affect author rights to archive accepted <\/span>manuscripts of academic contributions 12 months after their initial release (\u2018post-<\/span>print\u2019, not \u2018Publisher PDF\u2019) (cf. \u00a7 38(4) UrhG). Beyond the provisions of the UrhG, it is <\/span>irrelevant if the work had been largely sponsored by public research funds (50% and <\/span>above). Self-archiving rights extend to both contributions to academic journals and <\/span>collected editions, for which the author is not entitled to remuneration.<\/span><\/p>\n

Authors retain the rights to post the pre-submitted versions of their work (\u2018pre-prints\u2019) <\/span>on their author\u2019s homepage and the homepage of their affiliated research institution <\/span>with immediate effect. Should the work be accepted for publication, Nomos Publishing recommends replacing the pre-print with the published work or referring to the published work in the appendix. The publication of the pre-print and post-print on platforms of commercial providers (such as ResearchGate, Academia.edu or SSRN) and the public dissemination of the published version (Version of Record\/Published Version\/Publisher PDF) is impermissible. However, authors are entitled to pass on the pre-print and post-print to third parties in accordance with regulations governing private copies (\u00a7 53 UrhG).
The author is obliged to indicate the publication source of the initial release when making use of either his or her rights to secondary use or self-archive via a link to the electronic publication, i.e. to the DOI, unless otherwise specified. Details regarding our journal authors\u2019 rights to self-archiving can be found on the open policy finder website<\/a> (formerly known as Sherpa Romeo).<\/span><\/p>\n

Different guidelines apply to Open Access content. Please see the individual journal webpages for information.<\/span><\/p>\n\n

4. Remuneration<\/h3>\n \n

The rights stated under Pointer 1. are, insofar as author royalties are paid for publications, fully compensated by the agreed upon one-off lump-sum payment. Revenue-based royalties for print editions apply equally to digital editions and are invoiced at the same frequency.<\/p>\n

Nomos Publishing assumes that the waiver of royalties results in a lower grant requirement for publications which are financed by grants from authors, publishers or third parties. Therefore, separate remuneration claims can only be staked if new forms of use are involved and\/or the revenues generated by an existing form of use have markedly increased.<\/p>\n\n

5. Statutory Remuneration (VG WORT)<\/h3>\n \n

The author may independently contact the Collection Management Organisation<\/a>\u00a0(VG WORT), regarding his or her journal contribution and thus receive his or her statutory remuneration. This applies to both the print edition and the digital edition (METIS). All corresponding questions should be addressed directly to VG WORT<\/a>.<\/p>\n\n

6. Manuscript Submissions <\/h3>\n \n

Unsolicited manuscripts \u2013 for which no liability is assumed \u2013 are considered publication proposals on the publisher’s terms. The editors reserve the right to a longer review period. No liability will be accepted in the event of damage or loss. Only unpublished original work shall be accepted. The author agrees to any revision or editing of his or her work, provided the meaning of the text is not altered in any way.<\/p>\n

Contributions identified by name reflect the opinion of the respective author and do not always reflect the opinion of Nomos Publishing.<\/p>\n\n

7. Press Reviews <\/h3>\n \n

Nomos Publishing cannot guarantee the return of unsolicited contributions submitted for review, nor can Nomos Publishing guarantee that these reviews shall be discussed. Excerpts are used in accordance with the guidelines governing the use of press reviews as stipulated by the German Publishers and Booksellers Association <\/a>(B\u00f6rsenverein des Deutschen Buchhandels e.V.), as of Sep. 2013.<\/p>\n\n
