For many years, the ‘Publications on insolvency law’ series has provided academics and practitioners with a forum for in-depth analysis and innovative approaches to key issues in insolvency law.
The publication of the 100. volume emphasises the importance of the series for legal research and academic discourse.
The anniversary volume has now been published: ‘The Administration of the Collective Total Amount in Insolvency Proceedings Initiated under Section 38 of the VDuG’ by Dr Jan Schirpke.
This thesis provides, for the first time, a comprehensive analysis of the interface between distribution proceedings under the VDuG and insolvency proceedings, and offers solutions to the distribution conflicts arising from this. The starting point is Section 38 of the VDuG, which governs the concurrence of both proceedings. The study highlights the theoretical weaknesses of the provision, analyses its practical implications for trustees, insolvency practitioners and creditors, and develops approaches for the consistent coordination of both distribution procedures. In doing so, the thesis fills a gap in the research and provides guidance for both academia and practice.
